These Terms of Service ("Terms") govern your use of RSVPhere.app ("Service"), a product of H Factor Limited ("we", "us"). By using the Service you agree to these Terms.

Acceptance of terms

By creating an account or using the Service in any way, you confirm that you are at least 18 years old and that you agree to be bound by these Terms and our Privacy Policy.

Description of service

RSVPhere provides tools for hosts to create event invitations, collect RSVPs by email, manage guest lists, send reminders, check guests in via QR code, and export attendee data.

Accounts

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

Acceptable use

You agree not to:

• Send unsolicited or unlawful communications through the Service.
• Upload content that is illegal, infringing, abusive, or harmful.
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
• Use the Service to collect data without proper consent from your guests.

Subscriptions and billing

• Free plan. Available for limited use as described on our pricing page.
• Pro plan. Billed monthly or annually at the rates shown at checkout.
• Renewals. Subscriptions renew automatically until cancelled.
• Cancellation. You can cancel at any time. Access continues through the end of the current billing period.
• Refunds. See our Refund Policy for details on how refunds are handled.

Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle appears on buyer statements and provides all customer service inquiries, billing support, and handles returns and refunds in accordance with its Buyer Terms and Refund Policy.

Your content

You retain ownership of all event data, guest lists, and content you submit. You grant us a limited license to host, process, and display that content solely to operate the Service. Guest information is processed under our Privacy Policy.

Intellectual property

The Service, including its software, design, and branding, is owned by H Factor Limited and protected by intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the maximum extent permitted by law, H Factor Limited will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our aggregate liability will not exceed the amount you paid us in the 12 months preceding the claim.

Termination

We may suspend or terminate your access if you breach these Terms or use the Service in a way that harms us or other users. You may stop using the Service at any time.

Governing law

These Terms are governed by the laws of the jurisdiction in which H Factor Limited is established, without regard to its conflict of law provisions.

Changes to these terms

We may revise these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance.
